Tidewater Fishing Permits & Access
Virginia's Tidewater region has several areas that require permits or entry fees for fishing access — from Back Bay National Wildlife Refuge to False Cape State Park. Here's what you need to know before you go.
No Beach Driving Permits in Virginia
Unlike the Outer Banks of North Carolina, Virginia does not allow ORV (off-road vehicle) beach driving on its ocean beaches. Vehicles are prohibited on the sand at Virginia Beach, Sandbridge, and all Chesapeake Bay beaches. The OBX ORV permit systems (Cape Hatteras National Seashore, Currituck County/Carova, Cape Lookout National Seashore) do not apply in Virginia. Instead, Virginia offers excellent walk-on, bike-in, and boat access to its fishing areas.

Back Bay National Wildlife Refuge
Located in southern Virginia Beach, Back Bay NWR offers excellent surf fishing, kayak fishing, and wildlife viewing. A visitor entrance fee or annual pass is required.No ORV beach driving is permitted on the Atlantic side within the refuge. Access is by foot, bike, or kayak.

False Cape State Park
South of Back Bay NWR, False Cape State Park is one of Virginia's most remote and pristine coastal areas. Entry fee or daily/annual permit required. Reached by foot, bike, kayak, or seasonal tram from Back Bay NWR. No beach driving.

Virginia Beach Oceanfront
The Virginia Beach oceanfront and resort area beaches are free and open to the public. No permits needed for beach access. Surf fishing is permitted outside of designated swimming areas during lifeguard season (typically Memorial Day to Labor Day). No vehicles on the beach.

Chesapeake Bay Beaches
